About The Ombudsman - 40th Anniversary

We are celebrating the fortieth anniversary of this State body not only at the service of democracy, the Rule of Law and fundamental rights, but also as defender of peace and interlocutor between the three traditional State powers – – executive, legislative and judicial.

The Ombudsman was created in Portugal in the year of 1975, more specifically on 21st April. This State body whose legitimacy is substantiated in a pre-constitutional legal-political system which gained further grounds in the Constitution of 1976, has anchored its democratic legitimacy in its election by the Portuguese Parliament, with the Law and Constitution establishing the Ombudsman as an independent, single-member, irremovable and impartial body.

The Ombudsman defends the fundamental rights, freedoms and guarantees of the Citizens and seeks to solve their problems in a manner that is swift, free of charge and informal. This body assures the justice and legality of the exercise of public powers, appraises complaints and issues the competent bodies with the necessary recommendations to prevent and repair injustices and illegalities. It seeks the specific justice that is sometimes not possible to achieve within the formal system, but which is accomplished through informal means and the exercise of influence, persuasion and, ultimately, recommendation by this State body. The Ombudsman also represents a National Institution of Human Rights.

The scope of intervention of this State body primarily occurs among the Public Administration services in the defence of citizens’ rights, especially the defence of environmental, urban and cultural rights, the rights of taxpayers, consumers and economic agents, social rights, the rights of workers, the right to justice and security and rights, freedoms and guarantees; health, education and constitutional values. The Ombudsman may also conduct inspections and visits to these services.

In our democratic system, the Ombudsman, therefore, represents a constitutional body which guarantees fundamental rights and freedoms and defends Human Rights, also serving Justice and the Law, and through its action strengthening our democratic culture and the dignity of human beings.

The strong tie linking him to the community, in addition to its unequivocal defence and accomplishment of human rights, gives the Ombudsman a mission of guardianship of the immaterial heritage of the entire society. For this reason, it can well be stated that the Ombudsman commemorates 40 years with the citizen.

Celebra-se o quadragésimo aniversário deste órgão do Estado ao serviço da democracia, do Estado de Direito e dos direitos fundamentais, mas também como órgão de pacificação e de interlocutor perfeito entre os três tradicionais poderes estaduais – executivo, legislativo e judicial.

No ano de 1975, mais concretamente no dia 21 de abril, foi criado em Portugal o Provedor de Justiça. Este órgão do Estado que encontra a sua matriz legitimadora em um ordenamento jurídico-político pré-constitucional, que ganhou, todavia, assento na Constituição em 1976, tem ancorada a sua legitimidade democrática na eleição pela Assembleia da República, recortando a Lei e a Constituição o Provedor de Justiça como um órgão independente, unipessoal, inamovível e imparcial.

O Provedor de Justiça defende os direitos, liberdades e garantias fundamentais dos Cidadãos e procura solucionar de forma célere, gratuita e informal os seus problemas. Assegura a justiça e a legalidade do exercício dos poderes públicos, aprecia as queixas e dirige aos órgãos competentes as recomendações necessárias para prevenir e reparar injustiças e ilegalidades. Procura a justiça concreta que, por vezes, não é possível alcançar dentro do sistema formal, mas que se concretiza pela via da informalidade e através do magistério de influência, de persuasão e, por último, de recomendação exercido por este órgão do Estado. O Provedor de Justiça é também Instituição Nacional de Direitos Humanos.

O âmbito de intervenção deste órgão do Estado ocorre preferencialmente junto dos serviços da Administração Pública na defesa dos direitos dos cidadãos, em especial, na defesa dos direitos ambientais, urbanísticos e culturais, dos direitos dos contribuintes, dos consumidores e dos agentes económicos, dos direitos sociais, dos direitos dos trabalhadores, no direito à justiça e segurança e dos direitos, liberdades e garantias; saúde, educação e valorações de constitucionalidade. Pode ainda realizar inspeções e visitas a esses serviços.

No nosso regime democrático, o Provedor de Justiça apresenta-se, pois, como um órgão constitucional de garantia dos direitos e liberdades fundamentais e de defesa dos Direitos Humanos, servidor ainda da Justiça e do Direito, fortalecendo, através da sua ação, a cultura democrática e a dignidade da pessoa humana.

O laço forte que o liga ao sentir comunitário, bem como a inequívoca defesa e realização dos direitos da pessoa humana atribuem ao Provedor de Justiça a missão de tutela do património imaterial de toda a comunidade. Por isso, bem se pode afirmar: o Provedor de Justiça comemora 40 anos com o cidadão.
